LEGAL OFFICER (TEMPORARY JOB OPENING)

Organizational Context

The Independent Investigative Mechanism for Afghanistan (IIMA), established by Human Rights Council Resolution 60/2, is mandated to collect, preserve, and analyze evidence of international crimes and serious violations of international law committed in Afghanistan. This role, based in Vienna pending the final determination of the IIMA's seat, operates under the Chief of the Collection, Analysis and Sharing Section.

Job Purpose

This Legal Officer role supports the IIMA's mandate to prepare case files for criminal proceedings related to international crimes in Afghanistan. The incumbent will provide legal and policy advice, assess evidence for admissibility and reliability, and contribute to the preparation of case files and evidentiary modules. Responsibilities include conducting legal research, drafting legal opinions and correspondence, and potentially interviewing witnesses and suspects. The role involves handling complex legal matters, coordinating with other legal officers and investigators, and advising on substantive and procedural legal issues of international and domestic criminal law, ensuring compliance with international legal standards for fair and independent proceedings.

Responsibilities

The Legal Officer will provide legal and policy advice on case file preparation and the IIMA's investigations. Responsibilities include assessing collected evidence for legal requirements such as admissibility and reliability, and contributing to the preparation of case files and evidentiary modules. The role involves independently handling complex legal matters, coordinating and directing the work of other legal officers, analysts, and investigators, and supervising junior staff. Additionally, the incumbent will prepare or supervise the preparation of legal documents for national authorities, serve as a legal focal point for investigation-related issues, and assist in drafting and updating Standard Operating Procedures. The role also includes assessing investigative priorities, identifying avenues for investigation, and conducting interviews.

Work Experience

A minimum of seven years of progressively responsible legal experience is required. Desirable experience includes five years in international criminal law, working in a domestic or international criminal tribunal, drafting or reviewing indictments, experience in the Afghan context, prosecuting sexual and gender-based crimes, and addressing conflict-related crimes against children.

Skills

Proficiency in international legal procedures and instruments, international criminal law, and international criminal tribunal practices. Experience in criminal investigations and prosecutions, litigation, and legal writing. Strong analytical skills, ability to handle complex issues, work in multicultural environments, and manage multiple projects under deadlines. Computer proficiency and experience with legal research tools. Teamwork and collaboration skills. Planning and organizational abilities.
