Organizational Context
The UN Secretariat's Economic and Social Commission for Western Asia (ESCWA) supports member states in developing and reforming cyber legislation. This role is part of a broader initiative to assist Yemen in establishing a personal data protection law, aligning with international standards and regional best practices to foster digital transformation and protect individual rights.
Job Purpose
This consultancy aims to support the Ministry of Telecommunications and Information Technology in Yemen, in collaboration with UN ESCWA, to develop a comprehensive Personal Data Protection Law. The purpose is to modernize Yemen's legislative framework to meet the demands of the digital age, ensuring responsible and trustworthy use of digital technologies. The role contributes to strengthening trust in digital services, safeguarding individuals' privacy rights, and supporting Yemen's digital transformation efforts in line with global developments like the Global Digital Compact.
Responsibilities
The consultant will conduct a comprehensive review of existing Yemeni legislation and relevant international/regional best practices in personal data protection. This includes analyzing current laws, identifying gaps, and engaging with national stakeholders through interviews and meetings. A key responsibility is drafting a suggested Personal Data Protection Law for Yemen, incorporating principles such as data minimization, purpose limitation, and data subject rights. The draft law will address legal bases for processing, special categories of data, cross-border transfers, and the establishment of a supervisory authority. The consultant will also present and validate the draft law with national entities and finalize the report with an implementation roadmap.
Work Experience
A minimum of 5 years of demonstrated experience in drafting or providing regulatory advisory assessments for personal data protection legislation is required. Familiarity with the Yemeni legal system or civil law systems in the Arab region is desirable, as is expertise in digital technology and digital identity issues.
