Job Purpose
The purpose of this consultancy is to provide specialized legal expertise to develop an e-transactions and trust services law for Yemen, aligning it with international standards and regional best practices. This initiative is crucial for ensuring legal certainty, trust, and security in Yemen's digital environment, enabling safe participation in the digital economy. The role contributes to the broader UN objective of promoting responsible and trustworthy use of emerging technologies for sustainable development, building upon ESCWA's prior work in cyber legislation.
Responsibilities
The consultant will conduct a comprehensive review of Yemen's current laws related to digital technologies and analyze existing legislation and regulatory frameworks. This includes performing a gap analysis and identifying key national stakeholders for engagement through interviews and meetings. The consultant will draft a suggested e-transactions and trust services law, incorporating international and regional best practices, UNCITRAL model laws, and relevant EU regulations. The draft law will address definitions, legal recognition of electronic records, signature equivalence, trust service regulation, cross-border recognition, automated transactions, and enforcement mechanisms. Finally, the consultant will present and discuss the draft law with national entities, update it based on feedback, and deliver a final report with implementation recommendations.
Work Experience
A minimum of 5 years of demonstrated experience in drafting or advising on e-transactions legislation, electronic signature law, or trust service regulation is required. Familiarity with PKI frameworks and certification authority regulatory models is desirable. Experience with the Yemeni legal system or civil law systems in the Arab region is an asset.
