Furthermore, it will incorporate landmark judgments from relevant international jurisdictions, offering persuasive references for Malaysian courts to advance TIPSOM case conduct. By developing this resource, the consultant directly contributes to the Government of Malaysia’s national action plans (NAPTIP 3.0, 4.0, NAPFL, NAPBHR) and its commitments under Alliance 8.7, ultimately enhancing legal capacity, increasing prosecutions, and securing convictions in TIPSOM cases.
Responsibilities
The consultant is primarily responsible for the comprehensive review, update, and finalization of an existing TIPSOM (Trafficking in Persons and Smuggling of Migrants) case compendium, tailored for judges and legal practitioners in Malaysia. This assignment, spanning approximately 25 working days over two months, involves several key duties. Extensive Legal Research and Analysis: Building upon the current draft, the consultant will conduct a thorough legal review and in-depth analysis of relevant case laws pertaining to Trafficking in Persons (TIP) within Malaysia. This includes consulting legal journals, databases, and other authoritative resources. Furthermore, the role requires identifying and analyzing landmark judgments from pertinent international jurisdictions that could offer persuasive insights for Malaysian courts. Compendium Development and Submission: The consultant will develop and submit the initial revised version of the case compendium, ensuring it integrates comprehensive analysis and insightful commentary on the reviewed cases. Feedback Integration and Finalization: A crucial responsibility involves actively incorporating feedback provided by IOM and other relevant stakeholders into the revised compendium. The consultant will then produce and submit the final, polished draft of the compendium, ensuring it fully meets its objectives as a robust reference tool for legal professionals.
Work Experience
A minimum of 7 years of relevant professional experience in anti-trafficking and smuggling of migrant law is required. Essential experience includes prior work in migrant protection thematic areas within Malaysia and a demonstrated professional record in reviewing legal jurisprudence. Work experience with IOM and/or other UN Agencies is considered an advantage.
