As a UN specialized agency, FAO leads global efforts to defeat hunger and ensure food security for all. Operating in over 130 countries, FAO Country Offices provide policy advice, technical assistance, and capacity development aligned with national priorities and international standards. FAO Malawi, through the EbAM project, is assisting the Government of Malawi in strengthening its legal and institutional frameworks for Geographical Indications (GI) in line with international standards.
Job Purpose
The incumbent will support the Government of Malawi in developing its national Geographical Indications (GI) system. This involves reviewing and validating the national GI legal framework to ensure compliance with Malawi's legal drafting standards and legislative procedures, under the guidance of an International GI Legal Expert. The role includes facilitating national dialogue and coordination among competent authorities involved in GI governance. Additionally, the position supports the development of legal templates for GI Inter-Professional Associations (GI-IPAs), creating roadmaps and procedures for implementing the GI legal framework and registration system, and providing legal support for the preparation and registration of pilot GI Books of Specifications and associated producer organizations.
Responsibilities
Organize regular update calls with the project team, international consultants, and LEGN to report on progress. Submit draft deliverables to LEGN and the project team for clearance, incorporating feedback as needed. Review and finalize draft reports and GI legal provisions, ensuring compliance with Malawi's legislative drafting standards and providing recommendations for adoption and implementation. Facilitate institutional dialogue and coordination with relevant ministries and authorities to support the development and operationalization of the GI system, monitoring progress and preparing summary reports. Provide legal advice on institutional mandates for GI administration, certification, and protection, including support for establishing or strengthening a competent GI authority. Develop model legal templates and guidance documents for the creation and governance of GI Inter-Professional Associations. Design and deliver legal orientation sessions and capacity-building workshops on GI law and international obligations for stakeholders. Document legal best practices and lessons learned. Develop a practical roadmap for the adoption and implementation of the GI legal framework, including institutional roles, registration procedures, and control mechanisms. Prepare guidance and procedures for the legal registration and governance of GI Inter-Professional Associations. Provide legal support for the development and registration of pilot GI Inter-Professional Associations. Perform other duties as required.
Work Experience
Requires at least 5 years of relevant professional experience in legal analysis and legal drafting. Experience working with government ministries, particularly in policy formulation, legal advice, or regulatory reform, is also necessary.
Skills
Key skills include results focus, teamwork, communication, building effective relationships, and knowledge sharing. A strong understanding of Malawi's legal and institutional landscape on Intellectual Property Rights (IPR) is essential. Familiarity with GI systems, international standards (e.g., TRIPS, Lisbon Agreement), and related legal instruments is required. Proven ability in legal reviews, drafting legal texts, and providing policy advice is necessary. Excellent communication and facilitation skills are crucial for working with multi-disciplinary teams and diverse stakeholders. Specialization in Intellectual Property Rights, Trade Law, or Associations Law is an asset.
